The Freedom of Information Act 1982 (Vic) (‘FOI Act’) gives everyone the right to access documents held by government agencies and Ministers, including local councils.

We encourage you to contact the FOI Officer by contacting 03 5434 6000 before making a formal application.

The FOI Fact Sheet describes a snapshot of the FOI process, the documents we keep and the ways you can access them.

Some information is freely available and can be obtained without making a FOI request. Some information may be exempt from release such as personal affairs information of others or information that is provided in confidence.

Freedom of Information Part II Statement 

The Part II Statement provides a snapshot of our powers and functions, the documents and information we keep and the ways you can access them. Providing easily accessible information reduces the need to submit FOI requests under the Act.

If you cannot locate the information you are seeking after reviewing the Part II Statement and conducting a search on our website, we encourage you to contact our Freedom of Information Officer on 03 5434 6000 or email [email protected]vic.gov.au before making a formal FOI request. In some instances we will be able to provide you with the information you are seeking without going through a formal process.

 

How to make a request for information

Your request for documents should be as specific as possible to enable a search to be conducted. Please ensure you have stated the type of document(s) you are seeking (such as ‘planning permit’, ‘report’ or ‘letters’) and avoid phrases like ‘all documents’ or ‘any records’.

Note: If you are applying on someone else’s behalf you will need to fill out a Client Authority Form which is designed for solicitors, law firms, insurers and other parties representing FOI applicants.

You may submit your request the following ways:

Online

Please complete and submit an online form.

If you submit an online form, you will be required pay your application fee in person at:

Alternatively, you can attach a copy of your low income concession card issued by Centrelink and we will assess your eligibility of a fee waiver.

Note: The City is exploring the provision of online payment methods for FOI requests.

Please note, to limit the spread of COVID-19, we have closed our Customer Service Centre until further notice. Please submit your application form and pay the application via an alternate method.

If payment of the application fee would cause you hardship, please include an attachment to your email which supports your eligibility for a fee waiver (i.e. a copy of your low income concession card issued by Centrelink).

Your application must be accompanied by any supporting documentation and the application fee in the form of a cheque or money order made payable to the Greater Bendigo City Council. Please do not send cash.

You will be required to pay your application fee to a member of staff at the front desk. We accept cash, credit/debit card, cheque and money order.

What’s next?

We will tell you within 14 days that we have received your request. We will give you our decision and the reasons for that decision within 30 days of us receiving a valid application and the application fee. This time may be extended if third party consultation is required or by your consent.

The City is also entitled to charge prescribed fees associated with searching for and providing access to the documents. A summary of charges is as follows:

  • Search time - $22.20 per hour or part of an hour;
  • Photocopying - $0.20 per A4 black and white page; and
  • Supervision time if the Applicant inspects the document - $22.20 per hour or part of an hour

Note: If the estimated charges exceed $50.00, we will ask you if you want to continue with the request and ask you to pay a deposit.
