Livestock exchange User Agreement

Greater Bendigo City Council, and;

Gate will open 30min prior to event start time.

The user agrees to use the Facility in accordance with the Terms and Conditions se out in the attached schedule.

This agreement will operate during the period specified in item 4 above.

Schedule

Terms and conditions

  1. In this Agreement:

    Facility means a building, oval, playing field or other sporting area, amenity and other areas designated for use by Council;

    User means the person, either natural or legal (incorporated entity or body), to whom or to which the use of the facility is granted.
     
  2. The User will pay all fees as required by Council.
     
  3. The User will have and maintain, for the duration of this Agreement, a public liability insurance policy for an amount no less than $10M.
     
  4. The public liability policy will provide cover to the User for any act or omission or negligence that may cause loss, death, injury or damage to any person, equipment, personal items that can be directly attributed to the use of the Facility, and also provide cover for any damage to Council property and assets that is caused as a direct consequence of the use of the Facility.
     
  5. The User will report all injuries resulting from any activity (other than those directly related to a sporting event) to Council within 24 hours of the injury occurring.
     
  6. The User is not permitted to alter any electrical installations without written permission from Council.
     
  7. The User will immediately report (by phone) any concerns about the safety of any person in and around the Facility.
     
  8. The User will comply with the following conditions in relation to the use of the Facility:
    • to leave the Facility in a clean and tidy condition after each use;
    • to remove all rubbish, food scraps, empty drink containers, bottles and cans from the Facility and place them in the bins provided outside the Facility;
    • to sweep and clean up any spillage with appropriate cleaning liquids and agents and leave the toilets in or adjacent to the Facility in a clean and sanitary condition;
    • store any equipment in a safe manner;
    • to vacate the Facility on or before the end of the time of use and to turn off all lights and close or lock all windows and doors;
    • to observe the strict no smoking policy that applies to all Council Facilities;
    • to only use designated car parking unless otherwise approved by Council;
    • to keep the Facility in good condition, including carrying out any repairs or fixing any damage caused as directed by Council;
    • to pay for the replacement of keys or any items belonging to Council that have been lost or not returned after use;
    • to obtain the relevant approval for the erection of any signs within or outside the Facility;
    • to obtain the necessary permits for activities requiring a Permit, including liquor and entertainment licences;
    • to ensure that permanent marking products are not used without approval from the Council;
    • to co-operate and comply with all Council health and safety initiatives and directions;
    • at the end of this Agreement, the User will ensure that the Facility is left in the same condition as at the start of this Agreement, except for reasonable wear and tear;
    • the User will co-operate and comply with any reasonable direction or request of the Council in relation to the use of the Facility, including, where appropriate, maintenance.
       
  9. The User agrees that if the User breaches any of the above conditions:
    • Council may, at its absolute discretion, terminate this Agreement; and
    • if this Agreement is terminated under sub-clause (1), the User, its members and any invitees, must immediately vacate the Facility; and
    • the Council will not be liable for any loss or damage arising because of the termination of this Agreement; and
    • the Council will be entitled to recover from the User the cost of remedying or rectifying any breach of this Agreement.
    • The User accepts full responsibility for:
      • any loss or damage to any personal property (including money, jewellery or credit cards);
      • property on hire or loan; and
      • any contents stored at the Facility, prior to, during and after the period of use.

 

Special Conditions

The User agrees to comply with the following Special Conditions:

  • Sheep and cattle yards, ramps, gates and fences are not permitted to be used and their use is not provided for in any part of this agreement.
  • Bendigo Livestock Exchange may be suitable for low-speed vehicle activity, including but not limited to Bicycle, Tricycle and Motor-Vehicle events. 

However, all users must ensure they assess and implement any safety control necessary for the safe activity of these events. Bendigo Livestock Exchange can be accessed at all times by vehicles, including large Trucks.

Traffic management controls must be implemented to the satisfaction of the user to provide a safe environment. Where Bendigo Livestock Exchange staff at present, all directives must also be followed.

Safety barriers, traffic cones, impact protection must all be considered and if required - supplied, fitted and removed by the user.

Complex Hire – Full Day: $495.00

Complex Hire – Half Day: $250.00

Complex Hire – Conference Room: $210.00

Complex Hire – Conference Room – Weekends: $480.00

Complex Hire hourly rate: $20.00
