Approval of building plans that don’t meet Victorian Building Regulations.
Applicable building regulations:
- Regulation 87 (2) - Siting of Class 10a buildings
- Regulation 89 (3) - Front fence height
- Regulation 90 (2) - Fence setbacks from side and rear boundaries
- Regulation 91 (5) - Fences on or within 150 mm of side or rear boundaries
- Regulation 92 (2) - Fences on intersecting street alignments
- Regulation 94 (6) - Fences and daylight to habitable room windows in existing dwelling
- Regulation 95 (3) - Fences and solar access to existing north-facing habitable room windows
- Regulation 96 (3) - Fences and overshadowing of recreational private open space
- Regulation 97 (2) - Masts, poles etc.
Supporting documents:
- Certificate of title
- Plan of subdivision
- Any covenant agreements (if applicable)
- Written approval from neighboring property owners (if applicable)
- Architectural plans, including a site plan and elevations
- Details of any buildings on neighboring properties
- A written explanation of why the application is needed and how the building design meets the Minister’s Guidelines MG/12 (see Assessment Sheets below)
