First step – Internal Review before Court:

  • Before electing to have the matter proceed to the Magistrates’ Court, you are strongly encouraged to apply for an internal review of the infringement.
  • An internal review does not prevent you from still electing to have the matter heard before the Magistrates’ Court.
  • You can only request one internal review per infringement.
  • If you disagree with the outcome of this internal review, you can then request the matter be heard before the Magistrates' Court.

  • You must be the registered owner or the person/company listed on the infringement notice.
  • If you have engaged a lawyer to act on your behalf for this matter, a written authority allowing your lawyer to act for this specific purpose must be provided.

Court Hearing Application:

  • You can elect to have the matter heard before the Magistrates’ Court. To start this process, you can complete this online application form
  • If you elect to have the matter heard before the Magistrates’ Court, the City will incur legal costs by engaging legal representation for this process.
  • If the Court upholds the infringement against you, the City will seek a Court order to recover any legal costs from you.
